Offences under the Motor Vehicles and Road Traffic Regulations

A lot of road traffic tickets can be beaten with the right advice. Every time I go to Magistrate's Court I see the errors on tickets, but regular citizens don't realise that a lot of those mistakes can result in a ticket being thrown out.

With that being said, I'm hoping the list below will help persons determine whether or not the ticket received from a Police Officer or Traffic Warden is fair and legal. It will also assist in ensuring that your vehicle is fully compliant with the motor vehicle and road traffic laws of Trinidad and Tobago.

The Motor Vehicles and Road Traffic Regulations are contained in the Motor Vehicle and Road Traffic Act 1934, as amended.

  2. I truck hit and damaged my car, while I was parked on Aranguez Road, I reported the matter to the police while the driver did not. The police is telling me I am wrong and have no claim because I was parked in a no-parking zone and the entire Aranguez Main Road is a no-parking zone.The are no signs posted anywhere on Aranguez Road informing the public of it being a no-parking zone and also the police is saying there is no trace of that vehicle number on their system. Is Aranquez main road a no-parking zone? and how can it be right for a truck driver to hit a parked vehicle and not report it and get away without compensating the other driver

  3. I got a ticket today. The ticket has the location wrong. Also the ticket has two Time one which is 8:33am the other at 8:48am.also the ticket has "the December day of December 2016 at Eastern Main Road So Dorado". I was not I wasnt on the Main Road and the time was 9:00am. What should I do appear in court or pay?

  4. I was pulled over for being on the shoulder but wasn't, I got sandwiched between to cars coming off the shoulder and was pulled over with them.

    I told this to the officer who took my license and reg. he came back in a short while and gave me my stuff. Is there a possibility I could still receive a ticket in the mail?

  5. good day hear is what i need help with my gf is 19 an she was driving my car someone hit her from the back an she run into a next car and that person run into a next car she is not on my insurance will the next insurance company fix my car and what happen if she end up in the hospital

  6. I was issued a ticket for driving while holding a mobile device however i was attempting to select a contact on my phone to call tru the bluetooth deck.
    Also, the officer misspelled my name on the ticket.
    Should i pay the ticket?

    Your information is very useful.
    I have a query that I am unable to clarify properly even from the information I am reading. Both side mirrors of my vehicle was stolen and I am in the process of getting replacements. They are taped up to prevent further damage as the motor is exposed. I made a report to the police when the incident happed and I have that in the car. Until it is fixed can I be charged for them not being functional? And under what charge? Defective Fittings? Thank you in advance.

    1. I'm not certain which offence, but if the car is defective it should not be on the road. If you are stopped, you may encounter a reasonable member of the service... but you also may not.

  9. i was issued a ticket not far from where i live for my tint ...officer claims that my vehicle tint is too dark ..i have 35% all round and 50% in my front windshield and not once have i had and issue concerning my tint... how ever i was given a ticket and told to remove the tint... i attempted to remove it but was not making much progress afterwhich the police called a wrecker and wrecked my car to chag station ...the inspector say that front windshield tinting is illegal and told me if i remove it i can go i went by a near by shop purchases some razor blades and when i do remove the tint after some time told me that my car is impounded and i have to now go for my certified copy...is this the a lawful method that the officer exercise and also my car is listed white on the ticket and its really beige .....

    1. The police has no authority to order you to remove your tint, far less tow it for that reason. NONE!

  10. i was being issued a ticket by an officer, for parking on a corner while in my vehicle waiting on someone to enter my car at the same time being approached by the officers and his assumption was i was too close 2 the corner , but no measurement was taken , i did not accept the ticket and i left , what happens now?

  11. Hi I got a ticket ticket this morning. I went up long circular road and it was only after I pass the point where I was supposed to turn did I realize and that I wasn't suppose to go any further. I stopped immediately and then was signaled by the two policemen to come up further. I eventually got a ticket but it was genuinely a case where it was only when I passed the turn off I didn't realize I wasn't suppose to go any further.

  13. Hi I got a ticket but the officer wrote the wrong license plate number. It was a number from another vehicle which he mixed up. Do I have to pay this ticket or is it void?

  15. Ticket issued NO12 Regulation28(m)(1) $1,000
    Had to jump start my car on the highway, the jump caused head lamps to blow, Only the right lights were functional. Drove 200 meters away and was flagged by an officer who informed me of no headlights. Ticket was then issued.
    Can this be contested in anyway?

  17. I got a ticket on 3rd November, 2017 for using PBR.
    I will like to pay on 20th November.

    Will this be 14 days in total or 14 working days?

    My court day is 24th January, 2018.

    I got a ticket today. The officer only said that I have a cracked windshield. He took drivers licence and insurance and came back like 20 minutes after and handed me ticket without saying a word. Then kept badgering me to reverse out and leave, while I am trying to put my documents back away and could not even get a chance to read the ticket.
    Ticket seems so far without fault, except that the date it occurred was 20th November, 14 days to pay, then 2nd February 2018 to appear in court.
    I read Chapter 48:52 and it says " 7. Proceedings in respect of an offence deemed to be instituted by a notice under this Act shall not be listed for hearing in Court unless—(a) a period of two months has elapsed from the last day on which the penalty is payable and the clerk has no record that the fixed penalty was paid in accordance with section 5(3); and
    Am I correct to think that this date should then be February 4th 2018, which is a Sunday, and so then it should be February 5th 2018? Would February 2nd be soon? And would that make the ticket void?
    The regulation quoted says months and not days. I'm thinking Nov 20th plus 14 days is December 4th and then 2 months gave me Feb 4th or 5th?

    Also, my crack was welded, and the officer did not let me explain that? How does that make my windshield defective?
    Do you think I should go to court to challenge?

  20. Hi got a ticket because the officer said he can uldnt see through my car because the windscreen is so heavily tinted. Only the top of my windscreen has a strip but my court date is 13 February 2018 which is carnival Tuesday. What do I do. Can’t attend court on Carnival Tuesday

  21. I got a ticket for “wearing a seatbelt across my waist only” and 43c (i) was quoted. That law states that a ticket is given if a seatbelt is not worn. Don’t I have grounds to contest the ticket? If so, when do I have to contest? In 15 days of receiving the ticket or on d court date stated on the ticket?

  24. Hi. I was issued a ticket on a Sunday morning while I was waiting for my mother to use the ATM. I explained this to the officer but he still issued the ticket. I was not obstructing any traffic. Another car was parked and no ticket was issued. Can we challenge this?

  26. Hello. I was issued two tickets last week along with another driver/vehicle... one ticket for parking on a sidewalk/footpath, and the other ticket for breaching a no parking sign... However, one of the tickets has an incorrect driver's license number. Will I be forced to pay both fines?

Hi good day my name is Marlon Skerritt, on 17th December of this year I was given a ticket for my tint being too dark, I drive a black vehicle with black leather seats a black dashboard and black trimmings, the weather was overcast and I was wearing dark clothing at the time, all of which contributes to tint looking darker than it actually is, with that being said I told the officer that my tint wasn't so dark as he clearly nodded at me when asking me to pull over because I pointed to myself to confirm if it was I he was pointing to. I reiterated that my tint wasn't as dark as he thought but due to the conditions it seemed that way, he took me out the car to view it, the angle at which he was placed was reflecting a lot of glare which would obstruct vision but at another angle he would see clearly, he insisted on the veiwing angle of least vision to prove his point...in a nut shell can this be contested in court and would you represent me?

I made a right turn onto a street and then observed the no entry period between 2:30 - 6 PM, as stop and proceeded to reverse I looked up and saw a traffic warden 2ho shun3d me to come down.not wanting to be rude and just reverse I obliged, when she informed me that i breached a no entry. I told her yes and was about to reverse when u signaled to come to you. I got a $1000. Fine should I pay?

  32. Hi help me here just got a ticket for having a cell phone in my hand, I was not using it, however the officer stated he issued me the ticket at 2:15 pm (I was at work that time) but observed a cellular device in my hand at 2:50 pm can I contest that I was not at the location at 2:15 pm?

I was involved in an accident on 18 June 2018, this accident also involved a Suprientendant of police, I were issued a ticket for being on the PBR and missed the court date which were August 28th 2018,today I was set up in a sting operation by 5 police officers and given a summons to attend court for driving without due care and attention. Is there any this legal? After so long they are now issuing this summons? Please advise as this is really having me concerned.

  35. Went to Piarco Airport to drop off dinner for my son who works there. Spoke to him as I was entering the airport and he told me he would meet me just before arrivals (where the shuttles would normally be). When I got there he was not outside as yet so I decided I better make a spin and come back as I noticed police close by. Just as I was about to pull off a police vehicle blocked me and 4 officers came out. The lone female officer came up to the driver's side and asked me if I knew this was a no parking area and I advised I had just stopped to give my son his dinner. She asked where he worked and I informed her of the company while she looked in thw direction I of the doors to see if he was coming. She then said well I will nees to see your insurance and dp and just as I was about to hand her my Son came up to the car and I handed him the food. She paid no mind and took my documents into the car and handed it back along with a ticket for $1,000.00 to another officer who gave it to me advising that I had until a date in May to pay the fine. Can I contest this in court?

  38. Good day, this ticket has a defect. Time is off and the Am/Pm section. The officer that suppose to have witness the event wasnt the officer on the written ticket, which means he doesnt have firsthand knowledge of the event. went to court today and pointed out the defect to the judge,(but not the witness of incorrect officer because this was only realized after court) but she wasn't willing to dismiss. I didn't want to enter a plea until the defect was dealt with. Judge said officers can amend the ticket to put the correct time I guess? How can they amend this? I know it's in the books, but doesn't that stifle my due process?

    She put in a no guilty plea for me and set the case off. My case is next month.

    I will be fighting my case in pro-per.
    What are my strong points to focus on? From this first instance, I don't think they appreciate me because of my questioning.

  40. I got wrecked for parking in front of my family's property located between court street (from the photocopy shop) and Irving street (flow building). There is no signage and there was no paint on the road until 1 week after I lodged a complaint (the paint however was placed on the opposite side of the road from where I was parked). Now that street bends but is not classified as a corner (by some officers at the station I spoke to) does the 9 meters of a corner apply even when there is no signage and are there any exceptions for residents.

  41. I ran a red light in Port of Spain in front of the Central Market. I expect that I was caught on camera. How long will it take for me to get a ticket in the mail. It may not show my face but I expect they will have my car number plate in the picture.

  44. Good day I was issued a ticket for driving over the required speed limit. On the ticket all information is correct except my vehicle. The officer indicated a red cruze when its a sonic.
    My point is on the said date of the ticket i was not driving a a red cruze with the said number plate. This can be a factor of miss leading information or shall I just pay the ticket?

  46. I went through the red light at around 2 30 am at the mololney traffic light . The police came out of mololney and collected my documents saying I would be given a summons to come to court and explain why I broke the lights .I did it for safety reasons . What are the procedures
