Adverse Possession

Q:
What is Adverse Possession?



A:
Land owners must exercise control over their land because if they don't, another person (stranger/squatter) in occupation of that land may eventually be able to apply to the court for an order that he or she is in adverse possession of it.

Precedent on this matter comes from UK case law, but significant local case law on this topic is Salamat v Rajack & Others HCA NO.S1103 of 1994. Other cases include, Lucas v Jordan CV 2006 - 03612 and most recently, Harriram, Robert v Gopaul, Brandon; Gopaul, Simone H.C.S.1785/2002.


The law of adverse possession is grounded in the Real Property Limitation Ordinance Ch.5 No.7 sections 3 and 4 , which sets out the requirements to succeed in a claim for adverse possession:
(1) factual possession of the land for 16 years or more and
(2) the animus possessendi, that is, the intention to exclude the world.”
(Per Deyalsingh J. in Lyder v De Freitas H.C.A. 1310 of 2001 at pages 20 and 21 and see Poyer v Freitas Cv 2005 – 00632 at pages 17-79).

“Factual possession signifies an appropriate degree of physical control. The stranger must take control of the land and must make use of the land in full and open to the public and without interference from anyone. Examples of some acts that may show adverse possession are building on the land, fencing the land, living on the land, planting on the land and rearing livestock on the land. The more things done on the land, the more convincing the case for adverse possession. See Lord Browne-Wilkson in Pye v Graham [2002] 3 WLR 221 [P.C.] at page 234.

As for the animus possessendi “what is required is not an intention to own or even an intention to acquire ownership but an intention to possess“(see Pye op cit pg 235 AB) <--- VERY IMPORTANT!



Who is considered to be a stranger?

A stranger is someone who comes on or remains on the land without any permission and whose occupation has not been interfered with.


Exceptions:


(1) If a person occupies land by reason of some permission from the true owner then he or she cannot claim to be in adverse possession.

(2) If a person occupies land as part of some family arrangement, he or she cannot claim to be in adverse possession of that land.

(3) If a person occupies land under a tenancy agreement and has been paying rent all along, he or she cannot claim to be in adverse possession of the land.

If, however, a person occupied land as part of a tenancy agreement and has stopped paying rent, then that person’s adverse possession starts when the rent was stopped being paid.

  1. Good day. My mother has occupied her father's house for 22 plus years. She was invited to stay there by him while he lived abroad. She paid all the house taxes and insurances prior to November 2014. She also constructed a garage and made general repairs to the home. All the neighbours recognize her as the person who occupies the property. However she was served with an eviction notice recently. Does she have any rights at all to this property

    My great-aunt died in 1999 and left a half lot of land for my mother who has provide money for the surveying of the property. However, to-date, all she has is a receipt for the money paid for surveying and nothing else. The will was probated in 2007 and attempts to obtain paperwork for the half lot from the executor has been unsuccessful. Contacts to the attorney who completed the probate informed my mother that since one cannot get a deed for a half lot of land she should be paid out for the value of the half lot. My mom is 80 years old now and would like to settle this part of her "estate" prior to her passing as she foresees problems down the road to her heirs. Please advise as to the best way to resolve this issue. Please note the half lot is adjoining with a cousin's half lot who also received no deed or monetary compensation. Please advise and thank you in advance for your response.

    i just received a deed in my name to a land that is 4 lots ... i was told that there was a family that is squatting there for over 20 years they stopped paying rent and was told to leave and acted aggressive when told to move off the land. the man that stopped paying rent moved off the land with his daughter and left his common law wife and son. today they are building on the back of the land, they made changes to the board 'house by adding on concrete structure. is there anyway i can get them off? i found some tax receipts that was paid by my family. is there anyway i can stop them from building and get them off the land that is now in my name?

    my dad, his brother and mother names are on a deed pertaining to one parcel of land. My grandmother gave my dad the said land to occupy and build,and gave my uncle next to her, which is a distance from the said land.My father build, occupy,planted, and fenced the entire parcel of land with no interferance. We are currently living on the land for the past 35-40 years. When we were going to fence the entire parcel; my dad contacted by grandmother which my uncle tagged along as well, for he did not knw how close to run the fence to the neighbours house, which is my aunt. We dont get along, hence the reason for contacting my grandmom. On preperation to fencing the land,my uncle and grandmother said that there will be no intereptions with anybody including my aunt because the land is yours. After fencing, we constructed a shed and cast a driveway on the side of our house. Couple of years after, they saying that they want there share, and they never gave word that the land is ours.
    -what should we do in terms of claiming the entire parcel of land?
    -if not what are the other options?

    My father bought a piece of property my name is on it also,he has since died and i am the owner but the roadway that came with our property says full and free right for the purchaser to do whatever we want etc,but alongside that same roadway is a piece of land that no one lives on and doing research for myself i found that their property was bought before ours but it came with no provision for them to access their property and in front of the said land is a house once owned by the the original owner of all the properties now my father cut the roadway we have drains and it is a private roadway and is a mix of grass and lime stone in all it is 16 feet wide 100 feet long the owner of the land started to allow the neighbor on the east side to plant and park his old rubbish on the land but they started to move bold and want to use my driveway for bring septic trucks to park and for this clients to come drop or park their cars on the land the man has a garage that paints cars and he is not even E.M.A approved but now what is my legal rights can i have a lawyer letter sent to both the owner and the neighbor telling them they don't have access to the road and i have been taking care of this roadway for 25 years now can you please tell me what i can do to end this problem thank you.

  6. My great grandmother and my dad received legal permission from the land owner to occupy a piece of land of which they paid rent. They stopped paying rent when two other persons had stepped forward claiming ownership. My greatgrand mother and my dad are now deceased. Our family has lived on the land for over 80years. The owner is also deceased but his son has now moved to evict us. We only have a few receipts for the rent payments and the letter where my great grandmother was allowed to stay. Do I have any legal right. ? Or should I just move.?

    My brother who lives abroad was given a house by my parents verbally. When he was leaving 15yrs ago he told my other brother he can stay until he got somewhere, because his girlfriend at the time was pregnant.

    That same brother, his common law wife and one of their kids has been very disrespectful for the past years.

    My mother recently took them to court, the judge ruled their is nothing the courts can do, because no rent was being paid.

    Can you advise us how to go about evicting them.

They have verbally notified us that they intend to take back posession of the said space which is approximately 1000 sq ft. Our driveway is concrete and covered with a steel and galvanize roof and it was built more than twenty years ago in full view of everyone. Is it right that we must give up half of this existing structure? Do we have any rights?

    1. Yes, you have rights... more than they do actually. Visit a lawyer for more advice because I see this going to court.

  11. Good Day man.
    The situation begins where a grandmother had a rental arrangement with landowners, spanning over 30 years. Upon her death, her son kept occupancy of the house and the two lots of land.

    However during this time, he was unable to pay the rent since for some time before, the landowner stopped coming to collect, whether by sickness or death. He made attempts to get names, did searches and eventually did an affidavit stating he was unable to pay since no one was coming.

    Eventually, well after over 7 years or so, an individual claiming to act on behalf of the owners appeared with an eviction notice, refusing to collect the rent from him or negotiate a new arrangement or a 'transfer' of the rental agreement to him. He was willing to pay at this time, even the arrears. At times the individual even avoided his house when they came to collect from neighbors.

    Unfortunately he died as well, and his sister (at whose house he spent his last days) continued occupancy. He is close with her family, since her kids spent lots of time with him, even going to school from there, and he also spent time at their home as well. The kids always came in to spend time and even clean up at holiday times.

    After seeking info, the family eventually found the 'agent' and offers were made to clear the arrears and continue the rental. They even offered to purchase, but the 'agent' rudely and abruptly shut down any suggestion of such, stating that no payments were made for over 11 years and the 'shack' on the land is to be demolished by her....Threats to break the house down were made, and she also claimed that the land was sold.

    To this day despite being served two letters, she refuses to or cannot show any legal documents stating that she is the agent of the rightful owner to the land.

    Would the family be justified by pursuing this matter to the courts?

  12. our family was allowed to live on a piece of land for 39 yrs, permission was given by the owner who paid the taxes, however the owner died years ago, he had no wife nor children how do i go about obtaining the land i did a search for a deed in Legal Affairs could't find the deed. i dont know if a will was made nobody has come forward to date. what do i do?

Recently a group called Hyarima is claiming that they own the land and we have to pay for it. But initially these people were not around and when all the houses in Pinto was being built no one came forward. What rights do they have? My dad paid land tax for many years.     I recently purchased a lot of land and I recently found out that a neighbor who is renting next door to the property I bought has a registered Adverse Possession for the Property. According to the documents he has it states he has been on the property for over 18 years without being interrupted. However, he has not been living in the area for 16 years to claim he has been occupying the property. The Property was fenced around by the other neighbours on each side of the land except the front area. The guy is claiming he has been cutting the grass on the land and planted a fig tree on it. Can you advise if I can do anything to claim my property?

  18. hi good day , my father occupied some stated lands more than fifteen yrs nw , he was doin agriculture on the land , banana and cocoa, he died two yrs ago , he applied for regularisation of the parcel of land we have all the documents , recently sme ppl came and built two small shacks and started to burn and cut down all the banana and cocoa plants , and is claiming it is there land , how do i get them out of the land so me and my brother can continue to cultivate the land and get the documents transfer to our name .and even get a lease for the parcel of land.

It was my grand mother own and she left it for me but she did not make out a will or anything so would I be able to get the deed of comfort or I won't ? I already started build over my house from.     We are living on a peice of land for the past 70 years. the current owner has purchased the land in 1979. we do not pay rent for the land. the owner wants to develop the parcel of land including the area we occupy for residential lots. he is threatening to evict us (via bulldozer) if we refuse to move. Do we have any rights in this matter? How can we prevent eviction?

  21. Hi my godmother owned a vacant parcel of land located next to my grandfather. She died approximately 30-years ago (abroad) and my grandfather paid all the land taxes each year until 2009. My godmother did not marry nor did she have any children. We are not aware of any relatives who are alive. We recently did a search of the property and it is still in the name of my godmother. can my grandfather now seek to claim the land?

  22. i live on a 5 acre parcel of land, 2 houses on the entire parcel. My uncle's and mine. my grandmom left a will before she died that stated her 5 sons to get 1 acre each, and 2 of the sons(named) will give 2 of their sisters 2 lots each.
    my dad occupied his 1 acre and so does my uncle. the sisters however is contesting this will and saying it was done while my grandmom was of unsound mind and their lawyer is claiming that each of her children should get equal shares from the 5 acre plot. my grandmom and my dad passed away 3 mths apart in 2010, he died first.

    my dad/myself have occupied the 1 acre for 33 years, do i have the right over them to claim for my 1 acre fully?

    i would like advice urgently on this matter, i have been reading other situations and i have not seen anything close to mines, my grandmother leased a piece of property more than forty years ago where she then gave her son my father to live on it for a price, now at this time the leased stated that they be on the property for 25 years at this time my grandmother was alive this was in the 70's so it came to pass that the owners of the property passed away and they had a guardian that was controlling the land where in which after the lease was up my father paid land tax to him, a few years ago approximately 8-10 years ago that person died who was collecting taxes. my father left us on the property us being my mom and the seven kids she had with her, the property was in a bad condition no water no lights bush every where leaking roof two bedrooms and my mom struggled and raised his kids on her own for more than thirty years we have developed the property over the years my question is can he take this property from his kids or apply for any kind of deed of comfort to take a loan or mortgage on the property because we are in the process of doing that presently to further fix and extend the property, placing emphasis that he was not on the property and we struggled to maintain the house and land can i have some advice on this matter please

  26. good morning, my father and grandmother are both joint tenants of a parcel of land owned by Aranguez Estate, since they are now both deceased my mother is now in the process of applying via letters of administration (she was married to my father).
    My question is can Aranguez give her (my mother) full authority or would/should it now be 50% to her and the other 50% be divided between their children??(meaning my brothers and sisters)??

My question is;(1) How can i get back the land he sold. (2)How can i become the sole owner of the land in front where we reside. (3)What is the procedures to aquire a deed for the whole land. (4)Do i have any say in the matter of trying to aquire a deed for the land and can i fight them for the land.

  30. Logic would dictate that the belief of ownership would be identical to the requirements embodied within "animus possessendi" if and only if the land was developed and made use of for the claimants personal habitation, pleasure or commercial purposes.

I called the Commissioner of State Land and they indicated to me that the old maps have records of private ownership to the land my common law husband and I have occupied for the past 10 years however the new data base shows that the land in which we occupy has no indication as to whether it s state own or privately own what should I do?

Can the titled owner offer deeds to individual persons in possession of his land adversely, during the period where another person is applying for adverse possession of the entire parcel of land that includes these same individuals? The person claiming adverse possession is purporting to be making this claim on behalf of the same individuals the titled owner wishes to offer these individual deeds to. The person is constructively using these individual possessors as a means to make himself the new titled owner of the entire parcel. Possession of a vast non -dwelt upon part of the parcel is still not easy to prove based on the requirements for possession e.g. infrastructure, buildings, income generating use of the land etc.

    i live next to a piece of land over 25 yrs. my grand parents my parents and myself used to occupy land. a company purchased piece of it. the contractor who got job to fill land is claiming ownership of land. who lives in the village also. myself and another neighbor filled a caveat against this. if he has almost done all proceedings to get land cand the caveat and myself and the 2 other neighbor file adverse possession for the land still.

  37. Hello and thank you for you time. My father lives on land owned by his grandfather and father. Recently he found out that his name was taken out of the deed without his consultation. The land on where our property is situated now has the name of a deceased uncle with his wife laying claim. We have lived on the land for over 30years and have contributed paying tax on it. My father is not that educated and isn't sure what he could do in the matter. He has done a will leaving the property and land to myself and mother in the event of his death. What can be done to formalise our position. Someone advise on taking a caveat on the land. Is this any good? Can my relatives make changes to the title deed without my fathers permission. Now, here we are in 2015 and an issue has arisen due to us now having the land surveyed, they are claiming that in order for them to move out, a family member would have to pay them a said amount of money. An eviction document was presented to them before and they did not pay any mind to it. What, in this case should I do? And is this admissible in a court of law? Can they claim Adverse possession?

    My grandmother had a will leaving her property to three children. one of them is my father who have lived with my grandmother for over 21 years. Since birth I have lived in the house. After my grandmother died two years ago my father gave the will and deed to his sister as she was the executor of the will. Now two years later she does not answer our calls and we heard that she is now saying my grandmother had a differnt wll that does not include my dad.

    Do I have any legal rights to the property as I have lived there for 21 years?
    Can you verify when a will was prepared?
    Is there a copy filed with the government?
    Since we have never heard of this new will can they move my dad and I from the property?

    The house s in need of major repairs, can I carry out this work without permission from all parties?

    The ast I knew my dad was named in the will can he erect a new room on the property without having approval of the others?
    As far as we know the will has not been probated, is there anything tha can be done to find out if it has been or compel my aunt who does not take our calls to give us the info?

  43. Good day. My parents have lived on a piece of land for a little over thirty years. The land is privately owned. The land was given to my mother by her grandmother (deceased) who subsequently had an agreement with the deceased owner more than 50 or more years ago. The land when my parents occupied it initially was basically forests, it now has electricity, running water, paved roadway, internet, cable due to my parents being proactive. i would like to know what can be done if anything to get the land legally on my parents name due to the fact that the owner has died and no one has come forward to claim it and the land has been drastically developed and we all call that place home. please let me know what can be done or whats the first steps if any to take.

    My uncle (wheel chair bound) gave me permission to build and construct under his house to live. I constructed a 2 bedroom, kitchen, living room and toilet and bath, walk way, and did everything that was needed to live in it. I lived there for almost 8 years.   45. on property law my husband and I have been liing in his mothers house since 1998 we have two kids 13 and 10 years the house was old and neglected and we have done extensive renovations , put up concrete wall separating the neighbour even did and extension rewired ,retiled upstairs and downstairs redid the driveway paid the taxes , the bills even has the bills in my husband's name all done so we could be given either the property or left on unhindered on the land she lives in the US for over 30 years also we bought a house next door to her in Florida which is in my husband's name which she collects the rent as an added income for her over there .... my husband left me in dec 2014 for another woman and now bought his mother to evict me from the property via a hand typed letter that i have to vacate in 3 mths all our savings as a couple went into that renovations and not towards a downpayment for a new home based on her promise can she evict me and the kids without recompense for all the renovations done and money she recieves from our property in Florida my husband is backing her but do we have to vacate or can we stall long enough to get back the money we put in before she sells the property

  46. My father-in-law is had a lease for a few acres of government land. He has been living and farming the land for over 25 , built his house and applied for a deed of comfort. he has given rights to a few lots to a woman he had relations some years ago. Another woman seeking to get into his life (she has a reputation for seeking her interest with older men, having gotten married to three old men already who passed away leaving her the sole owner of their properties (house and lands) My wife is the only child alive for her dad and she also has two nieces, a nephew and a child. Her father told her that everything he has will go to her and that he has no other heirs. My wife is not a person to take anybody's word, she wants to get something in writing giving her title to the property as well as giving each of her nieces and nephew their share each. She would also like to build her own home on the land apart from her father and use a portion to build some apartments for rent. They have both discussed selling off a few lots to raise the funds for this venture. Her father has sold off rights already to some of the land and is finally comfortable in his retirement. My wife is afraid that this woman who wants to get back into his life has only bad intentions and would like to prevent anything from happening to take away what she and her nieces and nephew are entitled to. What options does she have in having the property put in her name together with her father's so that she is ensured that no one can take it away? Please advise.

  52. Hi. If a person was allowed to live in a section of land owned by someone else, and they built on the land, they made improvements, and even grew a garden on the land for 20 years. But within that period, there was discussion between the owner of the land and the person occupying the land that if she continued to live there for a certain number of years, she would be able to get the land, provided that she continues to pay the owner of the land $1000. The owner of the land dies before she sign the section of the land to the person occupying the land. After the owner of the land dies, it passes on to her son. The son demands that the person occupying the land leave. Could that person successfully attain the land? Is this adverse possession?

    we live on an acre of land, which was given to us by my fathers employer pretending to be the owner of the estate wife. My dad worked on the farm for many years, we were squatting in another area my dad sold the house and came to the land promised to us, we build a concrete house on the land though the house is un-finished, my dad got telephone, when we went for her to fill out the form for water and lights, she kept giving us the round around. My dad did a search and found taxes were not being paid from since 1989, the researcher did a search on the land we occupied and found nothing. we assumed it belonged to the state, and applied and were able to pay house tax, after which we received water and lights.


    WE did a second search just to make sure it was state, but the estate administrator found title belonged to a man, to which he contacted, we did a lease and further did a survey and realize it was an acre, and then purchased the land and got a deed, after the lady died who pretended to be the wife of the deceased owner, another came claiming ownership but has a fradulent title.


    We researched the deed and realize that it is a fraud and found the lands belonged on the real property act


    from the time we lived there and paid house tax, got a lease then a deed has been 16 years can one claim adverse possession seeing that both deed and lease is a fraud? and we have proof we lived there continuously

  60. Good day can I please be guided accordingly. I was given a piece of land by my stepfather over 40 years ago, when I got married and started my family. My stepfather married my mother a little before my birth. I am 78 years of age. This land was given by word of mouth. I pay house tax and all utilities for my portion of the land. Both my parents have passed, but before my father died I was told that he signed the deed over to one of my sisters (there are 11 children in all and I am first born). I am an old man, so I asked my eldest son to construct a 30ft x 50ft home in my yard (this is my yard-space) and live there with me. My sister who has the deed does not approve of this and says she now has the deed and the land can only be given to brothers and sisters, no grandchildren are allowed. Can she do this although I occupied the land for all those years and pay my bills? Is there any way my son will be able to inherit my portion where he too was born and grown?

    I have a piece of land bordered on 3 sides by other land owners and by a reserve road on the fourth side. The Land is gently sloped and there is a benching along one of the boundaries. My question relates to the maintainence of the boundary. I would like to buid a wall along this boundary but am nervous as im unsure of what the land on the far side will eventually be used for and whether the small wall i intend to build will be suffucent to protect my property. If the other owner decides to develop this land is the onus on him to maintain the boundary to make sure the land from his property doesnt slip on to mine?

  70. I understand that the time limit in which to do a procedural appeal is 7 days after the hearing so in other words if my hearing was on MAy 24th, May 31st is the deadline to submit the appeal. My attorney says the 7 day process starts from May 26- June 2nd. He submitted the appeal June 2nd and says that it will be accepted by the other side and if they ( defendants)try to object the higher judge will not allow this as it is only one day later. IS he correct as he is demanding his fees for this appeal and we have no idea if he is correct, so dont want to pay him and then it is striked out and would have paid him in vain for no benefit. Why should we have to pay for his negligence

I am having some land problems and would be very happy get some information from you. so here goes.. my father came upon a parcel of land to live with my siblings and myself when we were very young. (aged 8 and so on) The original owners attempted to move us but was unsuccessful. So we continued living here. My 3 sisters all married and left the property over 25 years now. when my father died in 2009 he left a will stating that all his property be used by all his children for equal use and benefit. When we came upon this parcel of land to live, there was a old broken down wooden structure. when all my sisters got married and left i Eventually married and had children remaining on the property. It was my wife and i who rebuilt the old wooden house and cleaned the surrounding and continued to build a concrete structure, put fencing, dug drains, apply for electricity and water. No money or any type of contributions was ever given for these things by my father or sisters. It was only since my fathers death and the surfacing of his will that made my sisters show interest. Now they are threatening to take us to court stating that they want equal shares. keep in mind that my father never applied for a deed or possesory title during his time here. my questions is: Will they succeed? can they claim equal shares?

  72. Good day. My family has been living on a plot of land for over 70 years, one lot out of about 5 acres of agriculture land. My grandfather had a verbal agreement with the owner and paid rent up until 1998 or so. My grand father died in 2006 and the rest of the family continued to live on the land. Yesterday (21-June-2016) our home was destroyed by fire. We went to the MP, Regional corporation, etc. and they said that we can get a grant to rebuild however we need to get a letter from the owner stating that he is granting us permission to rebuild. The owner currently resides in Canada and has been doing so for a number of years now. Upon contacting him via the phone he outright refused to give us permission to rebuild, and it now seems that he wants us off the land. This is the only place me and my family know as home as we've lived there all our lives. My grandfather lived there from birth to the age of 79 when he died in 2006. Can the owner just refuse to allow us to rebuild our home after we've lived there so long? What are our options? What can we do now? Can the owner just capitalize on our unfortunate situation and use that as a basis to kick us off the land? Please advise. We really need some sort of guidance on what options we have and how to proceed?

  73. Good day. I have an issue that I need some assistance with. My family has been living on a plot of land for over 75 years. My grandfather had a verbal agreement with the current owner to live on a specific lot of land out of the 5 acres of agriculture land that he owns.     My family has been living on 1 lot of land since about 1955. In 2010 my grandfather the (statutory tenant) passed and my mother and I continued to live on the house (concrete 2 storey dwelling) which he constructed. Prior to the Act my grandfather was in talks with the landlords to purchase, however they were not able to sort out the boundaries of the property and thus an estimated price was never given and negations stalled. We continued to improve the property as the years went by (flooring, driveway)
    My mother nor I wrote to the landlords requesting to purchase or extend the lease as the Security of tenure Act stated as we were under the impression we would we engage talks with us to sell.
    The landlords have now written to us advising us that we are trespassers on the property and has asked that we leave within 28 days of the notice.
    Questions
    1. Do we have any rights to still purchase the land?
    2. Would we be entitled to any compensated for the house?

He is now stating that he is going to tile the outter part of my wall. Does he have any right to do as he wishes with the wall that I solely paid for? He did not even ask for permission, he told the contractor that he is going to tile it.

Before my father died he signed a letter of permission for T&Tec allowing his brother to get current. 1 year after he died which is like this month my mom is proclaiming the land to get it on her name bieng the legally married wife for 30 years. My fathers brother decided to contest it and sent a letter from his lawyer to our lawyer stating my father Promised him 2 lots of land a long time ago. We know this isnt true. He has no written paper whatsoever plus my dad don't speak to him.He is trying to take ownership and get 2 lots. What can I do? Is this possible?

One of the brothers does not want to consent to the mortgage because he claims he cant agree to the bank holding the property for 10 yrs. But my mom cant renovate without going to the bank. She lives there, over 34 yrs, pays water, electricity n land tax. He does not live there or contribute financially..what can she do to prevent him from blocking her while trying to access a mortgage at the bank under the banks conditions?

Stepbrother has denied him. Does the divorcee have any legal rights to the property based on the verbal agreement?

And one day by some stranger came by when we was out for a couple of days and they ask him for a piece of land to buy and he sold half if 5000sq feet to the person without us knowing, and they paid him 3000 dollars and he was drunk at the moment and i really want to know what i can do to get back that land that he sold for 3000.     I've resided at a house for the past 40yrs and would like to know what could be done for me under these circumstances? My mother came to live at the premises and was paying rent for a couple of years. After maybe about 10yrs no Landlord ever came back for rent. My mom ended up leaving the house with my elder sisters and me for over 30yrs. In return my sisters also left for over 20yrs and I was left here alone to take charge and do what was necessary to upkeep the building. However, I've never paid rent and have never seen a said Landlord that even claimed that this is their property. What do you recommend for me at this stag? After all it's been about 35yrs now. Also, since it's been just me doing the fixtures and paying lights etc. Would my other siblings be able to claim anything?
