Joint Child Custody or Contact

Q: My wife does not want me to see my son, what can I do?




A: In my opinion, Joint Custody is best for the child to know both parents, so the following information is tailored towards that opinion.

The law governing applications for custody of children under the age of 18 years, in the Magistrates’ Court, can be found in the Family Law (Guardianship of Minors, Domicile and Maintenance) Act 1981.

By making an application for custody of a child, a person is applying for the right to possession and care of the minor, including:

the right of physical control over the child;

the right to discipline the child;

the right to control the education of the child;

the right to protect the child; and

the right to make medical decisions affecting the child.

According to Section 4, both father and mother have EQUAL rights, so here's the process.


Who can make an application?

A father or mother of a child can apply for custody, regardless of whether the parents are married to each other.

Any other person, not being a parent of the child who the court thinks has a sufficient interest in the child, for example, relatives such as grandparents, aunts, or older siblings, can also apply.


How to make the application?

(1) Make a plea before a Justice of the Peace or a Clerk of the Peace at the Magistrates’ Court in your district.

A plea concerning the reasons why you should be granted legal custody is done in an interview between you and the Justice of the Peace.

In the interview, you need to show that you are the child’s parent, if this is the case, and you must take with you proof of this. The child’s birth certificate can prove this. If you are not a parent, you must establish that you have a sufficient interest in the child.

On the basis of your plea, and the interview, the Justice of the Peace has to determine if you have sufficient grounds to make the application.

If the Justice or Clerk of the Peace finds that you have grounds to make the application, you are then directed to do so.

The application is made by completing a standard form for both married and unmarried people, which is given to you at the Magistrates’ court. You then take the completed form to the process or counter clerks to pay an application fee, and have the application processed.

If the child's parents are married, the fee is a standard three dollars (TTD$300), irrespective of how many children the application is being made for.

If the child's parents are not married, the fee is three dollars (TTD$300) for each child being applied for.

After the application is made, a court date and a summons is made out in the name of the parent or person to be excluded from custody.

You must take the summons to the summons officer in the police station nearest to which this person lives. It is your responsibility to ensure that the summons is served on the person.

You should provide the summons officer with the person’s proper address, and also make periodic checks with the officer to see that the summons has been served.

Once the summons has been served, the officer who delivered the summons signs a return of service form which is included in the court’s file for your matter.

If on the date that the matter has been assigned, the matter is called, and the summons has not yet been served (which will appear from the absence of the return of service form), then the matter will be adjourned until the person is served with the summons.


What happens when the matter is called?

When the matter is called, and you and all the other persons concerned are present, the court will ask whether the application is contested by the other parent (does the other parent agree or disagree to custody application). If it is uncontested, the court will proceed to deal with the matter immediately.

The court will grant custody of a child, if it thinks it fit, having regard to the welfare and the best interests of the child. The welfare of the child is the first and most important consideration above all others

On granting custody to the applicant, the court will usually grant a right of access to the child to the other parent or person(s), and may then go on to make an order requiring that the parent or person(s) excluded from custody pay to the parent granted custody, periodic payments for the maintenance of the child.

Where the application for custody is contested, the court usually makes a temporary order for custody of the child, until the final determination of the matter.

  1. Good Morning, I am desperate for any advice I can get on my situation. I have a four (4) year old son. His father is a Trinidadian but he lives in the US and has citizenship there. He visits for carnival only, so the only parent my son knows is me. I would like to apply for a US Visa for my kid because I travel yearly to visit my dad and siblings and would like to take my son with me however, his dad is declining to assist with this process. I've heard that I can file for full custody because as it stands he currently does not support our son nor is he in this country. What do I do? Also, if a summons has to be served what will happen granted he does not live in the country?

    My son lives with me and his dad has access. He makes things very hard for me. Does not drop him back when he suppose to, palms him off by his mother all the time, my son cries to come home and calls me crying at night when he leaves him by his mother. I want to migrate but he wont let that happen. If I leave without him knowing, what consequences I can face?

  5. you should record your conversations with him threatening to kill you, better to get a video recording for security purposes, make a report to the police station, file for joint custody

  6. My daughter is now 16mths and lives with her mother as we are not together. The problem is that the she has been refusing to let me see out child. I call she does not answer when she does it is to curse and be abusive . Sometimes she tells me I can see my daughter and when I am on my way she cancels or does not show up. She has been a menace and has now begun to call my work place to send messages that I am not taking care of my child. Every month I ensure transfer enough money. She has called my family my friends making it very difficult to get along with her. She has threatened me that should I seek visitation rights she will make a report to the police that I have done something to our daughter. I wnt to know what is the best steps to take . I want at least visitation rights to see my daughter. Her mother even refuses to give me a copy of the birth paper. I don't want any contact with the mother. What should I do?

    I am a father of 3 and I went to Court and my Ex got full custody and I got liberal access as I was being sent abroad to work. I always paid all maintenance whilst abroad and I was never allowed to see my children. I returned to the country and got a lawyer and went to court for joint custody to get visitation rights but my Ex has no lawyer and the case was adjourned for her to get a lawyer and for us to get more documents. Since the last Court date, over 10 months has passed and she denies me access. For the last 5 months I have withheld monetary maintenance and paid all school fees and transport only. I told her unless I am able to see my children, I would pay her no maintenance and I can purchase groceries for the children for which she says she needs the money. I have to visit my children school to see them. A new court date is 3 months away but I still do not get to see my children. When I asked her what is the arrangement for liberal access, she said its when she wants. She now claims to have a Police friend who she said is getting a warrant to arrest me. I have the money to pay maintenance but I just NEED to see my children. What are my options for the next three months as I wait for Court. I am hurting inside by not getting to see them, not even to speak by phone. I asked my daughter who is 13 why she does not answer my calls as and she said her Mom always takes her phone away. I also have a recording which my daughter sent for me in secret where my Ex is telling her to never answer when I call the phone. What is your advice in the mean time please.

  9. I am the mother of a five year old with autism. Her father has not been very involved in her life u til recently because I have gotten a bf for a little over a year now. I took him to court but what he pays is a measly amount compared to her needs. His mother even tells him not to give any more money than what he gives in court. Every time I ask for money he says he doesn’t have or says he wants to see a receipt first but doesn’t understand that I can’t get a receipt if I don’t have the money to go to the appointment. He is very difficult and has threatened with court already because my current bf and I got into a fight and he think my bf is abusive to my daughter. He disappears for weeks without calling or offering any help and when he reappears he acts like he has a right to be in and out of her life as he pleases. I allow him to see her but he does not do anything she needs as it relates to her autism. Up to a few weeks ago he did not even know where her school was because he never showed any interest. I would like to apply for full custody. I have a better job and I live on my own which is better for her because he lives in a house full of people and they also have little to no understanding of autism. What are my chances of gaining full custody?

Currently I'm not neither father nor mother my fiancee has two kids with this previous partner that he pays maintenance for however when the matter has settled to $400 per week for the two children but recently the got lost of job and has changed his work and collects less than this previous work so he can't afford to pay than amount...with outstanding warrants..can somebody give me advice as what can he do can the money be drop in anyway??

  14. Good day, i am a single mom. I am unemployed because of my two elder children being ill and constantly in the hospital. I have my son father in court for maintenance. I later applied for a variation for half of school fees, uniforms, books, shoes and bag. After two yrs of dropping in my bills, i was told the order made was a temporary order. I was given back 2018 bills but the court dont want to give me back 2019 bills, i was told i have to reapply for the variation. My son father applied to decrease the maintenance and out of fear towards him i granted it because i was afraid how he would react with me when i step out of court. Now he reapplied again for a decrease and i am scared he will get it. I also applied for variation for martial arts classes and football classes. he works for almost 30,000$ a mth, how can i get him to increase?

Hi I am the single mother of a three year old her father has not contributed to her well being for the past two years as the time for her to start school we both appiled for her to attend a government preschool since I didn't withhold him from seeing her he asked to take her for a day which turned into 2 weeks and within that time he placed her in a school without discussion .I took him to court concerning the fact that he was not supporting her the day perior to the court date he took her to school and kept her without informing me he told the court that he always has her for school so she dismissed the case. My question is can I apply for custody of my daughter?
    because he is of the impression that he has custody of her

  16. My ex and I have a son together but he lives with me since birth. I do everything for him, I paid every doctor bill during pregnancy, I purchased everything he needed he was born and I continue to provide food, shelter and clothing for him. His father only buys Pampers once every 2 months. Now, he wants to file for sole custody. What is your best advice?

  18. Hi, I'm married but currently seperated, my husband was unemployed when we seperated and is still unemployed 9 months after we have seperated, he does photography as a part time gig. He does not contribute to both of our sons in any way and it is becoming overwhelming for one parent, can i bring him up for child maintenance as he is unemployed?

  19. My son is two years 5 months. His father left us last year March 2019.. I've always tried to keep him involved. Like I visited several times with our son, made several video calls, I told him about important events in the child's life. I have always been the one to push for him to have a relationship. Because before he left he said if he leaves now the child would forget him. I didn't want my child to not know his father who by the way is my husband. So I visited almost every weekend. He didnt have the basic necessities for us to be there but I went. This year he told me he wanted to spend time with his child separate and apart form me. I told him sure but proper arrangements need to be made. He didnt make proper arrangements. Is from calling to cancel then to not calling to confirm. So I decided I'm going to step back and let him try. But instead he sent me a letter saying that I have stricken him from decisions concerning our child which caused him stressand hes demanding to me to see his child within 7 days and failure to do so he would take legal procedures. What should i do?
