Consumer rights: no return, no refund


Q:
Is a "No Refund" or "All Sales Final" store policy legal in Trinidad & Tobago?


A:
  • *Section 15(1) - Where there is a contract for the sale of goods by description, there is an implied condition that the goods shall correspond with the description
  • *Section 16(2) Where the seller sells goods in the course of a business, there is an implied condition that the goods supplied under the contract are of merchantable quality, except:
    • (a) as regards defects specifically drawn to the buyer’s attention before the contract is made; or
    • (b) if the buyer examines the goods before the contract is made, as regards defects which that examination ought to reveal.
  • *Section 20(d)(ii) - A time frame should be given for returns, but if there is none, the customer has a right to return within a "reasonable time".

  • *Section 8(1)(a) - a seller cannot contractually exclude or restrict liability for defective goods, and/or
    • (b) negligence of a person concerned in the manufacture or distribution (e.g., delivery drivers) of the goods

  1. Hi, can your employer give you a warning letter for not intervening in an altercation that occurred in your presence five minutes after you finish your tour of duty.The altercation were between to other employees who were on duty at the job site.

  2. Hi. As a person working in a sales business is it legal for police to force a refund to a customer who cannot prove their goods are faulty? I see that as thuggery and it seems illegal.

    Hi, Can a store or business tell you that you only have one year warrant when the manual said you have five's.

  5. Hi I made a down payment on a nail course.. I wasn't told over the phone there's a no refund policy.. When I give the girl my money then she made the receipt and stamp no refund.. Due to personal reasons I can't attend the class.. Now she said I can't get back my $20000 ..what can I do?

    2. I have a similar predicament but for a nursing course. When I contacted the college via telephone to change course they told me it was $75. Then i got an email telling me it was $350 to change. I however asked for a refund because i no longer was interested in the course and is unable to get it. When i registered and paid a month's tuition in advance, they even put a no refund stamp on it. All I am asking them back for is my month's tuition fee. What can I Do??

  7. Good day,I bought a dress yesterday and I want to return it. When I called the store the woman said she has a "no refund" policy and that she would write me a credit note. Is there anyway that I can actually get the refund?

    i went to a store the other day and apart from terrible customer service when i came to purchase and item for $60, the card scanner would not print the receipt but it said approved and the sales clerk insisted i put my card in again, but i did not in fact i left.
    i went back the next day with a print out of my account showing that now, not only had my card been decreased by $60 but $120.the sales clerk called the manager and while we waited for her the clerk said none of this would've happened if i had just paid in cash- the store has a card machine and does not exclusively state anything about cash. when the manager finally came she was extremely rude in telling me that i could not get back any of my money and even called her "contact" from the bank and showed me a completely different account transaction of only $60. i took my item and left the store

    is there any action i can take against this store or even get my money back?
    as an additional concern i think the card machine has something wrong with it- innocently faulty or not, the entire place looks extremely questionable and lacks basic business ethics

  16. I joined the Princes Town Health and Fitness Gym and paid on special for 3 months and get 1 free offer. I was not told that there was a no refund policy. Now that i am not happy with the services provided as the instructor is always late and no guidance is given on how to use the equipment since reporting the unprofessional behavior of the instructor, i asked for a refund and was then told that there is a no refund policy. I advised them that i will pay for the first month but if they can refund me the balance and they said no i should have read the contract which no one explained the details. I even told then i an willing to pay for the first month in full but wanted a refund for the other months and they refused. Is it even legal? Dont i have rights as a consumer ?

  18. In an emergency situation, can a store tell you that you cannot get a refund, even thoug the items were not delivered and it is in their possistion?

    If they want valid reason for the return, as a customer do we have to provide confidential medical reports?
