Divorce

Q: What are the steps to getting a divorce in Trinidad and Tobago?



A: The law under the Matrimonial Proceedings and Property Act Chap 45:51.

Section 5(1) - a divorce petition cannot be presented until one year of marriage has passed, unless there are extreme circumstances.

Section 3 - the marriage must be at a stage where reconciliation is impossible.

Section 4(1) - The person initiating the divorce must prove:

(a) that the respondent has committed adultery and the petitioner finds it intolerable to live with the respondent;

(b) that the respondent has behaved in such a way that the petitioner cannot reasonably be expected to live with the respondent;

(c) that the respondent has deserted the petitioner for a continuous period of at least two years immediately preceding the presentation of the petition;

(d) that the parties to the marriage have lived apart for a continuous period of at least two years immediately preceding the presentation of the petition and the respondent consents to a decree being granted;

(e) that the parties to the marriage have lived apart for a continuous period of at least five years immediately preceding the presentation of the petition.


Section 4(2) - Empowers the court to investigate

Section 24(1) - A spouse may be entitled to maintenance especially when the other decides to leave his/her partner in a position that may impose a burden on society (benefits, etc.) i.e., disability or children. Most recent case at the time of posting: Ann-Marie Ramdhan v Peter Ramcharan, delivered on 22/06/2010.

If one spouse is overseas, Sections 62 - 62H lays down the law in that regard.

  1. hi, i've been married for nine years, during which my husband and i have been seperated five times. right now we have been sepeated for the past year. what i would like to know is if it possible for me a file for me to file for a divorce? during the time we have been married he has made severakl death treats to me an once i reported it 2 a police station where i wa advised to go to a court an request a restraining order against him, which i did, but he did not show up on the date given for a court appearance an i just never went back 2 do it over again. so again my question is it posible for me to get a divorce now or do i have to wait longer or what would be your advise for me?

  2. i am married for seven years was separated within 1yr and 3mths and does not have any children .I filed for divorce but missed the date for court because i did not get the correct date.6mths later my ex filed for maintainance in court should this be granted when she is currently living with someone else for so many years.

  4. my husband and i were 2gether for 18yrs, married for 15yrs and separated for a year and some months.i was force to leave my marrital home which is his mother's own, and which we both lived for the past 15yrs.because of his physical abuse and him telling me to go i had no choice, we have 12 &17. when i was leaving i took the the younger one cause where i went there was no room for him.he is a prisons officer and i own my own business but due to the separation in not making the amount i used to have due to i have to pay rent and other xpences. he pays maintainance of 750 which he suppose to pay 600 and half of school fees and books.oh my son choose to stay wit him.i wants a divorce but is it possible i can get a little more money from him after the divorce if i file for it instead of him. what are my consiquences can i benifit anything from him. because after all these yrs i just left my marrital home wit only the things i bought while we were living together.can he pay half my rent. another thing to he dont even take our daughter for no time at all, is there something i can do that he can take for weekend and we can share the holidays half and half. what should i do need some advice.

  5. hi, i have been in a common law relationship for 7yrs 7 months recently my spouse packed up and left our rented home i have a 6 yr old daughter with him and is presently 8 months pregnant i was told that there is an act Cohabitational Relationship Act where i could get support for myself n my daughter can u advise me on this . Another question i have if i want him to give up his rights as father to my daughter how do i go about doing such?

  6. HI, I have been married in trinidad but i am not from trinidad, i was living with that person for about 5 years, them this person started to get bad behavior... So I decided to go back to my country with our two years old daughter. Since it happened we comunicate hardly and have very bad comunicatioin. He maintenance his daughter only for the two first years and them stop it. I buy everything for our daughter... The question is... he doesnt do the divorce in Trinidad because he say.. he doesnt have time...Can i do it Trought Venezuela Embassy. We have been separate from about 8 year now... we meet in puerto La cruz on December 2011 to see her daughter after 7 years... the girl doesnt speak english and he doesnt speak spanish. I am an enlglish teacher but The girl always said that she doesnt want to speak english. my next question is Do you think i will have any problem to divorce because i came back to my country with my daughter?... She born in Venezuela.

  7. My best friend got married to a Canadian woman three years ago and has seen her a total of three times from the time they met to today as she lives in Canada. These three occasions were in the 1st year of the relationship/marriage. It was a whirlwind relationship but they never lived together as she returned to Canada after their honeymoon. He now wants to get a divorce so that he would be free to move on with his life as he has no intentions of going to Canada to be with her. How long would it take for him to get a divorce if a. She tries to contest it or b. She doesn't 'put up a fight' and willingly agrees.

Hi I have been married 9years before my husband left and decided he wanted to start a fresh in another country..he had walked out on my daughter and I and is pursuing a relationship with another woman who is now living in the other country with him,there is no support and I work on and off,4years after he has now filed for a divorce,what are my chances in receiving alimony?   11. I have attempted to find your email address to contact you with a question in order to get a direct response. I'm in Canada and have not had any luck finding info about obtaining a divorce for a marriage taken place in Trinidad over 2 years ago. I am a born Canadian and he is a Trinidadian. I will be filing for the divorce and need some assistance on the first step I need to take to get this matter started.

  12. hi how are you. i have read your responses and i would like to ask a question. i was married to my husband for 21 years. our marriage was an ongoing one of fights, quarrels hiting abusive language.i have three childre, ages 22, 21, 18. i pay support for my children. my husband does not work because he is very lazy. he lives near his parents and he is living with someone. the children stay with their grandparents. he collects the money from the court and goes by the bar with the woman he is living with, and they spend out the money by drinking and liming with friends. whenever we had court i would bring up the suggestion that the children collect the mooney but the magistrate said that there is no such law.it has been four years now since i have left and i would like to know the procedures for divorce. i am employed but do not have a lot of money, because half of it goes to the court. i also had to take out a protection order against him, because he was very abusive during the time when we have court. he say he doe not want to divorce me, but i have moved on with my life. i do not want anything from him . would i have to pay him any money. the house is his, and he has the children.

I have been married for the past 17yrs living together for 22 yrs, I was a housewife from 1990 to 2006, I started to work in 2006 at first it was okay but then it became a problem, he have been fully employed for more than 30yrs, my husband stop supporting the family, mind you my salary was small and have to support four children, the house we live in was left to him by his father, he owes a boat and two vehicles he only pays for two bill light and water, we can no longer get along, I continue to see him with one female for the past 4yrs, he have moved out from our bedroom, he have tell me to leave with our children, can he put me and the children out, what are my right If I file for divorce.

  15. Hi. My husband and I loss our daughter on the 15th January 2013 she only survive for a short time after birth. However for the past two years my husband told me that he is in love with a married woman and wants a divorce. There is a marital asset (house) and wants me to sign the divorce papers without contesting the divorce. He was summons to Court for a domestic abuse on (31/03/2013). I would like to file for a legal separation. Any advice on this matter as for grounds for legal separation.

    1. No cost. Carry the divorce decree and birth paper to relevant departments and they will alter records to suit: i.e., passport, id card, utilities, etc.

    Good day is it possible to do the paperwork for a divorce on my own. Also I dropped my maiden name when I was married because well I thought it would be forever anyways is there any major cost associated with regaining my maiden name. (I am not financially equipped to pay a lawyer and would like to now my options) Thanks

  20. Hi, I have been married for the past four years and living together for the past nine years. We have two kids together and one that is not my husbands(ie when we met I had a one year old) We have reports made by him in the police station of physical abuse by me and reports made by me of physical abuse by him ( meaning on different occasions he would report him and on others I would report that he beat me up).
    He owned a home (where we currently live) before me, would I be allowed by the courts to stay at the property until the last child reaches 18.Also, I recently quit my job because of him and wanting to take care of the family as he is a shift worker in the oil and gas industry and is hardly ever at home.

    I would like to file for a divorce and would like to know what if any thing I am entitled to(not the kids as I know that he will be made to pay maintenance) also can you send me a form to file ,if he contest ...how long are the proceedings and is this really determined by him contesting, and if he has to pay child maintenance is he automatically entitled to joint custody.

    1. Contact your closest Civil Registry for a form, complete it and return with the fee. If the other party agrees and everything goes smoothly, you don't have to do anything else.

  23. My wife was unfaithful twice. I want a divorce but not willing to give up the home since i spent all the money on everything, cause she wasn't working at the time. She hardly cooks or cleans anymore(totally different to when we got married) My salary isn't much more than hers like $800 more. . Is she still entitled to half the assets and do i have to pay alimony?

    1. It's not that simple. There is a lot more involved when deciding who gets what. Getting half is not automatic. Things that will be considered are:
      length of the marriage, the financial situation of each party (including their sources of income and opportunities for future acquisition of property), and the contributions of each party to the acquisition of marital property (including the contribution of the housewife).

    1. Yes, he will be given a certain amount of time to say why he thinks the marriage should not end and why he refuses to agree to a divorce. Once that time passes without a response, contact the court for proceedings to go forward.

    I saw that you stated that one of the grounds for divorce is: Unreasonable behaviour.
    I know that the word "Unreasonable behaviour" is self explanatory but does it fall under - my husband drinking, staying out late and using abusive language qualify as grounds to get divorced? I have lived with my parents and my father was the same way, my father becasue of his drinking problem started to 'beat' her. I refuse to live that way, my mother stayed and took the abuse. He has on many occasions told me that he wants to live a single life but he refuses to leave. He does not want a divorce but I do! Would I be able to apply for a divorce under these conditions??

    1. A marriage can be annulled in any country. As long as a marriage was not valid from the beginning, the court can order an annulment.

  32. Hi, my father has been separated from his wife over 30 yrs now and would like to get married to my mom who he has been with for over for 30 yrs. Does he have to file for divorce or can he just sign some other document dissolving the marriage. Does he need her signature to confirm the separation?

    1. Dissolution only works when there is full agreement about the separation of property, money, custody, etc. Otherwise, he will have to apply for divorce; both requires her signature. However, if she does not respond within the time limit, you can ask the court to go ahead with issuing the divorce decree.

  34. Thank you for starting up this blog. It is most informative and helpful. My question is: if both husband and wife of a 6 year marriage agree to get a divorce after 2+ years of separation and there are no kids involved, and both already agree on how the assets/property are to be separated...what is the length of time it may take to be granted such a divorce? I.e. What are the approximate time frames for the papers to be filed to the time the decree nisi and decree absolute will be granted? And also, would you advise hiring a divorce lawyer for such a case? How can a lawyer help in such a case? Thanks in advance for your help.

    1. The decree nisi should take 6 weeks. The absolute can take up to 6 months, but is usually much sooner.

      A Lawyer in a case like this is a waste of money.

    i am still legally married to an american citizen we have been separated 9 years now we have a son who is also an american who lives with me can i divorce him with out him knowing what about custody can he fight for custody of our son who now 12 ?

    1. No, you can't get a divorce without him knowing unless he moved from the address that the court would send the papers to.

      He can fight for custody, but if he hasn't been a part of the child's life for 9 years, it's highly unlikely that he will get it.

      Also, were you married in America? If yes, you should file for the divorce there.

Hi my wife filed for divorce in 2011, the divorce was granted but she never went back to the court after the six week waiting period to obtain the final decree, she lives in tobago and is refusing to go to the court to obtain the decree, I didn"t know she never went back , I have made plans to remarry in May of this year is there anyway for me to apply for the decree and could it be done within my time frame.

    1. That is not a complicated process. You just need to go in and they'll give you a copy. I think there is a fee.

Hi me and my wife has been married for four and a half years now after being married we stayed at my parents house, we are now going through a divorce and I will like to know if she has any rights to my parents house and can she be evicted, I assisted my parent with the fixing of the house before and after the marriage but it's their house it's in their name, my wife never assist finically or physically to this. Also i worked full time during the married and my wife worked part time and goes to school we have no children, my wife is now working full time and still going to school part time, so am I . I currently make more money than my wife will i have to pay spouse support to my wife, she is 26 and am 28.

    1. Only assets acquired during the marriage together can be contested. Your parents' house does not belong to either of you.

      Only the Magistrate can decide if and how much spousal support should be paid... it all depends on the facts presented during the hearing.

  38. i am married to a police officer for 23 yrs i filed for a divorce ,we built a house together no one has any bills to prove who bought what,he dont want to pay me anything i am leaving the house after the divorce,we have 3 kids 18(who will be in law school) 16 (just finished school)and a 5yr old he is keeping the kids .what am i entitled too? can i claim half of his gratuity payment he will retire in about 2 yrs

    1. No you can't claim any of his gratuity. If he's keeping the kids, the court would most likely let him keep the house.

  39. Hi...July 2013 will mark my one year marital anniversary....after 2.5 months my marriage fell apart due to arguments. In January 2013 an attempt was made at reconciliation but the other party refused to forgive and move on from the past. Can this marriage be annulled or will divorce be the only way out after the marriage make a year?

    I have been married for 4 years and separated for 2. Both my husband and I would like a divorce.

    I am 27 and he is 28, Iam being told that because of our age a judge may deny our divorce.

    Is this true? Would this be a smooth process?

    1. Age is irrelevant for a divorce. The circumstances for which a divorce is needed is the only important thing.

  41. He has an interest (some right) because of his significant renovations, but if you own the house, of course you have rights. If you plan on going through a divorce, the court will sort out the property issue.
