Maternity Leave Pay

Q: My boss doesn't want to pay me properly during maternity leave. Is there anything that shows how much he must pay?



A: Firstly, congrats on your pregnancy!

Secondly, you must be employed full-time for at least 12 months. If you meet that criterion, your protection lies under The Maternity Protection Act, 1998 of Trinidad and Tobago. Direct your boss to s.9(1) and (2), which states:


(1) An employee is entitled to thirteen weeks maternity leave and may proceed on such leave six weeks prior to the probable date of confinement as stated in the medical certificate submitted under section 8(1)(c) or at a subsequent date at the employee's discretion, and is required to return to work, subject to section 10, no later than thirteen weeks from the date she proceeded on leave.

(2) During the period of maternity leave, an employee is entitled to receive pay from her employer to an amount equivalent to one month's leave with full pay and two months' leave with half pay.

    I am a contract ECCE Teacher. I applied on the 5th January 2016 for five days vacation 11th to 15th in the month of July. At that time I didn't know i was pregnant. A few months after, 19th May, 2016 I applied for maternity leave from 18th July to 23rd October, 2016. Since I know vacation application was already in. My medical certificate states my due date is 27th July, 2016.
    I was told on 16th June 2016 to cancel my vacation and apply for maternity leave as of 27th June or 4th July.They said my leave date is too close to my due date and when I adjust my application then i will get my maternity approval letter. I am feeling forced to apply for maternity leave for a date in which i am not comfortable with. What should I do.

    I started a contract on september 7th last year and my due date is september 12th this year. I am entitled to vaccation leave from the 11th month. Is it mandatory that i proceed on maternity leave an entire month in advance? Or can i take vacation leave and start my maternity leave from september 8th?

    1. It is your choice. However, depending on where you work, the 12 months may not be a required by law.

  5. I am on a two year contract which ends in December, I am also pregnant and due in January, do maternity leave benefits apply to me since a person is entitled to go on leave 6 weeks prior to the due date, and what will I be entitled to?

    1. You are entitled to your benefits under the MPA and you cannot be fired during that period, although your contract ends. Contact our trade union: Trinidad and Tobago Workers' Association.

  7. Good day, is this site only for maternity right because my question is besides. I want to find out wherected or who to go to if my past employer took out paye deductions from my salary and never paid it. I realize that because I never got my income TD4 slip up until now and when I call the company , the manager told it is not there responsibility to do so but I know it is. What or where do I go first assistance?

  8. Good Day,

    I have an employee whose 13 weeks of maternity is coming to an end. She has requested additional maternity leave till the end of the year because the baby is still small.

    Is she entitled to this additional maternity leave ? Also, If we decide to grant her this, what is she entitled to - Salary wise ? Would she be able to claim from NIS as well for the additional leave she is requesting ?

Hi í am from Tobago. i was employed in a restaurant with a hotel in tobago in march 2017.under d hotel management.however the hotel has since in june of this year lease or rented the rest. to some 2persons i think for a yr.i am working no contract which is renewed every 6mths.i am still employed at the said restaurant.am í suppose to get any money from these present ppl í work for.or just nis i am on maternity leave at present they sent me off on the 4th dec.this yr although í informed them that my doctor says unless given a medically unfit to work letter í can Work up to the day bfor due date.also í hve 8dys í Work after pay closed on the 26th nov.they havent paid me up to this very moment í doral. Am í not supposed to b paid for those days.

  10. Hi. I have been continuously employed since 2012 on a one year contract. However I recently found out i am pregnant and my due date is october 28th. Now my problem is my contract ends on october 22nd and i will usually resume duties on october 23rd to start a new contract period.Is my employer required to pay me while i am on maternity leave?

  12. Good day I'm currently employed as a part time employee for the past 7 months. I am currently 17 weeks pregnant . To make a continuous year of employment for me would be difficult as the year Mark as well as my due date both fall in Sept. If health were to permit as well as the baby not coming before and I made the year do they have to grant me maternity leave with pay? I'm not sure how it works as the year Mark will be dead close to my due date . Also I know they are taking nis from my pay so am I entitled to any pay leave at all ?

Hi I am employed with a company I started working here on the 4th November 2017 being check last year August 2018 too see if NIS was being paid it wasnt other employees NIS was being paid except mines...I fell ill on October 30th got a sick leave to send in because I at that point didny know my sickness was off of pregnancy nuy not until a week after being really sick I knew I was pregnant because doctors were taking my sickness for acid reflux ...But anyway my employer refused my sick leave and told me ah u I ju focus kn getting better...I was home for 2 months prior to being real sick...second week of january 2019 I went back into MIN and made a complaint again NIB said they would have called incase if anything havent heard anything am due June 4th and my last day before I go off for maternity leave is the third week in May...prior to that my employer keeps asking if am going take my entire 3 months away...HELP PLEASE WHAT DO I DO AGAIN!!!

  19. Hi. I'm 3 months pregnant and have been working asaa cashier/ sales clerk at a clothing store for 1yr and 3mths since getting hired back. I'm now hearing from others that our store is closing down and when I brought it to the boss attention he denies it. Is there anything I can do if he do close down and I'm out of a job.? Will I be qualified for anything seeing that I'm only 3 mths pregnant? I already told him last month that I was pregnant.

  20. i was on extended sick for 2018 and then went on maternity leave mid january of 2018. they say i lost my sick days and not entitled to pay for the 14 sick days. Can anyone shed some light on this.

  21. If u are 32 weeks pregant an u are hospitalize due to pre labour contractions an u are given sickleave for bed rest cause theres a possiblity baby can cone does it affect yr leave

  23. Good day asking for my young friend. She is currently working at an institution and they don't pay NIS. They were promised that NIS would have been started in April and it's now August and nothing. She is now pregnant. How can she access the maternity benefit or does her employer have to pay her since they never paid NIS.. She has only been employed with them for 10 months
